Affiliate Terms

THE AGREEMENT:

This Affiliate Program Agreement (the "Agreement") is entered into by and between KB PARTNERS LLC, doing business as "The Fast Track Girl" (the "Company"), and the affiliate partner ("Affiliate"). This Agreement describes the terms and conditions governing the Affiliate's participation in the Company's Affiliate Program and outlines the responsibilities of both parties.

1) DEFINITIONS

"Company" refers to KB PARTNERS LLC, its subsidiaries, affiliates, agents, and representatives. "Affiliate" refers to the individual or entity participating in the program. "Parties" refers to both the Company and Affiliate collectively. "Affiliate Program" refers to the program described herein. "Affiliate Application" refers to the required application form submitted by the Affiliate. "Website" refers to thefasttrackgirl.com.

2) ASSENT & ACCEPTANCE

By submitting an Affiliate Application, the Affiliate represents that they have read, understood, and agree to be bound by all terms and conditions set forth in this Agreement. This Agreement incorporates by reference all other legal documents, policies, and guidelines posted on the Website.

3) AGE RESTRICTION

All participants in the Affiliate Program must be at least eighteen (18) years of age. The Company assumes no responsibility or liability for any misrepresentation of age by the Affiliate.

4) PROGRAM SIGN-UP

Affiliate Applications are submitted at https://live.thefasttrackgirl.com/manage/affiliate/register. Acceptance into the Affiliate Program is at the sole discretion of the Company. The Company is under no obligation to explain the reasons for rejecting an application. Rejected applicants may not reapply.

5) NON-EXCLUSIVITY

This Agreement is non-exclusive. The Affiliate is free to participate in other competing affiliate programs, and the Company retains the right to engage other affiliates and partners at its discretion.

6) AFFILIATE PROGRAM

Affiliates receive custom referral links that direct customers to Company product pages. The Company provides commission percentages based on qualified purchases as follows:

• Fast Track To TikTok Shop: 40%
• TikTok Shop Accelerator: 40%
• Fast Track To Passive Income: 30%
• Fast Track To Extra Income: 30%
• Fast Track To Design: 30%
• Fast Track Profit Accelerator: 30%
• Fast Track Clubhouse Membership: 40% monthly per active member

7) SPECIFIC TERMS APPLICABLE

The Company determines payout eligibility exclusively. "Qualified Purchases" exclude purchases from existing partners, customers who joined before the affiliate, fraudulent transactions, and purchases induced by unauthorized discounts or coupon codes.

8) LINKS AND TRACKING

Affiliate links track referrals for thirty (30) days. If multiple affiliates refer the same customer, the "Last Referring Affiliate" receives the commission. The Company utilizes third-party tracking platforms and bears no responsibility if platform changes, updates, or technical issues break previous links or affect tracking.

9) PAYOUT INFORMATION

Payouts require current PayPal information and applicable tax documentation (W-9 for US citizens, W-8BEN for non-US citizens). The minimum payout threshold is $30 USD. The Company processes payments monthly within the first ten (10) business days of the following month, subject to a Net 30 waiting period. Refunds issued within thirty (30) days of purchase will result in commission withdrawal. Affiliates may not earn commissions on their own purchases. All payouts are processed exclusively in USD.

10) REPORTS

Account dashboards display real-time data; however, figures are subject to change before final payout processing.

11) TERM, TERMINATION & SUSPENSION

This Agreement begins upon acceptance into the Affiliate Program and continues until terminated by either party. Affiliates in good standing will receive all earned and unpaid commissions upon termination. Non-compliance with the terms of this Agreement forfeits all rights, including any unpaid commissions. The Company reserves the right to terminate any affiliate account for policy violations at its sole discretion.

12) INTELLECTUAL PROPERTY

The Company grants affiliates a non-exclusive, revocable license to use Company branding solely for the purpose of identifying the Company on affiliate sites and promotional materials. Any unauthorized use of Company intellectual property constitutes infringement and may be subject to federal litigation. The Company receives the right to use Affiliate names and marks for promotional purposes in connection with the Affiliate Program.

13) MODIFICATION & VARIATION

The Company may modify the terms of this Agreement at any time, effective immediately upon posting. Affiliates will receive email notification of material changes. If an Affiliate disagrees with the modified terms, the Affiliate's sole remedy is to terminate participation in the program. The Company may enforce prior versions of this Agreement if any court of competent jurisdiction invalidates the current terms.

14) RELATIONSHIP OF THE PARTIES

Affiliates function as independent contractors and are not employees, partners, joint venturers, or franchisees of the Company.

15) ACCEPTABLE USE

Affiliates shall not engage in harassment, intellectual property violations, malware dissemination, fraud, illegal gambling, obscene content distribution, hate speech, unlawful information gathering, or any other activity that violates applicable law.

16) AFFILIATE OBLIGATIONS & FTC COMPLIANCE

Affiliates are responsible for maintaining their own websites and marketing channels, ensuring legal compliance, and posting appropriate FTC disclosure notices in connection with any promotional content. The Company monitors affiliate accounts for compliance violations and reserves the right to immediately terminate non-compliant accounts. Affiliates must comply with GDPR and all applicable data protection regulations, implementing adequate security measures for any personal data they handle.

17) MASTER RESELL RIGHTS (MRR)

The Company grants no ownership, content rights, or Master Resell Rights to affiliates. Participation in the Affiliate Program does not confer any rights to the Company's products, content, or intellectual property beyond those explicitly stated in this Agreement.

18) NO OBLIGATION, NO GUARANTEE

The Company makes no guarantees of sales success and provides no business opportunity assistance. Affiliates independently manage their own marketing efforts and bear all associated costs.

19) CLAIMS

Affiliates shall not make income guarantees, ROI promises, or represent the Affiliate Program as a "get rich quick" scheme, business-in-a-box, or business opportunity of any kind.

20) SOCIAL MEDIA

Affiliates must comply with the terms of service and community guidelines of all social media platforms when promoting the Company or its products.

21) REVERSE ENGINEERING & SECURITY

Reverse engineering, unauthorized access, encryption circumvention, and data mining of the Company's systems, products, or services are strictly prohibited.

22) DATA LOSS

The Company accepts no responsibility for the security of Affiliate accounts. Participation in the Affiliate Program occurs at the Affiliate's own risk.

23) INDEMNIFICATION

Affiliates agree to defend, indemnify, and hold harmless the Company against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from the Affiliate's misuse of the program, breach of this Agreement, or any misconduct.

24) SPAM POLICY

Mass unsolicited emails, unsolicited gathering of contact information, and illegal spam activities are strictly prohibited.

25) ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties regarding the Affiliate Program and supersedes all prior understandings, negotiations, and agreements.

26) SERVICE INTERRUPTIONS

The Company maintains no liability for scheduled or unscheduled interruptions to service or access.

27) NO WARRANTIES

All services are provided "as-is." The Company disclaims all warranties, express or implied, regarding the reliability, accuracy, or uninterrupted operation of the Affiliate Program. Tracking errors resulting from cookies, disabled settings, or other technical issues may prevent commission attribution, and the Company bears no liability for such occurrences.

28) LIMITATION ON LIABILITY

The maximum aggregate liability of the Company under this Agreement shall not exceed one hundred dollars ($100 USD), covering all claims regardless of type.
